Article by Tom Meyer

Being an effective negotiator takes quite a bit of skill, and confidence. Negotiating is just about getting things to go your way; its about getting your way and making the person you are negotiating with happy to give it to you!

There’s a negotiator in all of us and whether we realize it or not, we negotiate every day. Teenagers negotiate with their parents to borrow the car on Friday nights; parents negotiate with their kids to clean their room. Employees and employers both negotiate on every level daily. Someone, somewhere, at this very moment is working hard to convince someone else of something.

Most people get stressed out when it comes time to go buy a new car, but it doesn’t have to be that way. Learning a few positive negotiating skills can make any buying situation a little more fun and mutually beneficial to both parties.

The first thing that you need to remember is that you are negotiating for the best deal possible. Keep your motives honest and keep a positive, upbeat attitude. Next, you never want to get anxious or in a hurry; this could be translated into being pushy or overbearing. The person that you are negotiating with should feel as relaxed and unthreatened as possible. You really want them to feel like they treated you right and gave you a good deal, rather than you “worked” them.

Knowing when the time is right to negotiate is another skill to have; for instance, if you’ve been on your job for quite a while and you feel its time for a raise, timing is crucial. If your boss is high on life because benchmarks or numbers were met, then the time is right to ask for a raise or promotion. If his dog ran away, his car broke down and he spilled coffee on his shirt going into a meeting, its safe to say that the timing is all wrong. Observing and being patient will ensure success during your barter.

Knowing what you want, and keeping your eye on the prize, so to speak, will help you be persistent, and you can be persistent without being rude. When dealing with any type of salesperson, you have to realize they are going to try to get you to agree to the highest price possible, that’s how they make their money. And know that they always start high in anticipation that you, the customer is going to negotiate with them. At this point hopefully you have done your homework and you know the price you want to pay, so stand your ground. Remember; keep your eye on the prize. Your positive persistence will eventually wear the person down and you will get what you want for the price you want to pay for it.

It’s also important to be able to think on your feet. You know the end result that you want, but there is no way of knowing the objections the other person has, or what direction how the conversation will actually take. It’s likely that the person you are negotiating with has been down this road, and probably has some surprises for you. Don’t let that rattle you; just meet the objections with the positive reinforcements of your ideal end result. Stay in control of the conversation and always lead them back to the result. When your salesman, boss service provider says, “So how ’bout those Dodgers”, take the conversation back to the subject!

Knowing what you want and what you are willing to do to get what you want will enhance your negotiating skills. Remember, being positive and honest the very best policy. Add a little charm and how could anyone tell you ‘no’?

Question by ΣΨξ Θ∱ ЯΛ: was the lack of equipment the real problem in the hostage negotiation?

http://ph.news.yahoo.com/ap/20100824/tap-as-philippines-bus-hostages-fe2a5de.html

“Of course what happened was far from ideal. Nevertheless, we are congratulating our personnel because despite the lack of equipment … they risked life and limb,” he said.

is it really the lack of equipment? (not even a ladder from the hardware store?) where did our funds go??
who risked life and limb there?
should we congratulate our police?
your thoughts on this?

Best answer:

Answer by Coming Undone
Responding to hostage scenarios with guns involved is no doubt risking your life. Responding with lack of proper equipment is suicide. Unless you’ve been in a hostage situation (cop, or medic), you won’t know much how you are risking your life.

Article by Jacob Smith

If you have been delinquent with your IRS taxes, getting tax debt relief is necessary. However, some people are fooled into thinking that they do not need any kind of relief until the IRS starts harassing you for the back taxes and sending you delinquent notices. The IRS is notorious for being the toughest and the most persistent collection agency known to anyone; so do not assume that the IRS will not be able to locate you. They will find you and you will not only owe back taxes, but penalties as well as interest on the amount owed. So it is always a good idea to take care of your IRS tax debt while you still have time. There are many professional firms that will be more than eager to help represent your case and help you get some kind of a relief with your taxes.

Some people prefer representing themselves when it comes to getting tax debt settlement with the IRS. If you are not a professional, however, and do not have experience in these matters, it is a good idea to get help from a professional firm that is experienced in legal matters such as these. Usually, people who try to represent the situation themselves may not have the proper experience or the contacts required to achieve their acquired IRS tax relief. Without specialized training, it can get really difficult to handle such a situation. It is obvious that you do not want to end up paying more than what you owe, but if you do not have the proper experience required you may end up doing just that instead of getting any kind of tax debt relief.

You may feel that a tax negotiator will be too expensive for you to afford, but, in actuality, you will see that hiring a professional is worth every penny that you spend on him/her. With a professional, you can expect your income tax debt to be curtailed to a great extent. When the IRS realizes that the person negotiating your tax debt relief is well versed with the law, chances are a settlement will be reached in a minimal amount of time. This saves a lot of time, money, and most importantly, a lot of harassment as well. The IRS will negotiate better with someone who knows the law and it is very common that when you deal with your own income tax debt, you end up negotiating on a higher level as compared to what a professional would have negotiated.

There may be only one way of making sure that you settle your IRS tax debt, and that is by letting a professional company represent you. In fact, it may not be difficult at all for an experienced negotiator to get IRS debt relief for you. Just the idea of getting debt tax relief should be enough to hire a professional instead of representing yourself with the IRS.

Naturopathy is a medicinal branch that is termed as a form of alternative medicine and it is centred on a belief in vitalism, which posits a special energy called vital energy. This branch of medicine possesses a holistic approach. Thus appreciates minimum intake of unnecessary drugs or injections and marginal practice of surgery.

Article by Elaine Daniel

Although many people may be unaware of the fact; selling products or services is a skill. Sales training courses are a way to develop this skill and increase the potential of a sales-team, to reach and accomplish its goals. There are many different technical and personal skills which are needed to ensure success in this industry, many of which will be covered and explained in good-quality courses of this nature.

One of the key attributes that any sales person needs, regardless of which arena or field they find themselves in, is a good and positive attitude. As many of them learn, the beginning of a successful sale starts with a solid foundation of inner confidence and a sincere sense of conviction that their product or service is the best that the market has to offer. This attitude is subconsciously communicated to their potential client or customer long before they communicate verbally.

A sales pitch is basically a short, detailed “speech”, that a salesperson has rehearsed beforehand, which can then be used as a promotional communicative tool when approaching a potential customer or client with a product or service offering. While this has to be delivered in a very short time, it needs to contain vital elements such as what the purpose or function of the product/service is, how it can benefit the buyer and why it is superior to any other product/service in its league. Courses will demonstrate how to construct an informative, yet brief pitch.

The value of good and pleasant customer service should never be underestimated. It may ensure that once-off customers become part of a loyal customer base. These communication skills as well as the ability to solve problems quickly and efficiently are vital tools to have for a successful career in this industry.

There are many forms in which this industry presents itself, one of which being telesales, or selling telephonically. Salespeople in this arena will learn proactive personal skills like patience and tolerance. They should also be equipped with skills regarding how to use the relevant technical systems. These combined skills, when used correctly, are indispensable selling tools.

In “face-to-face”, or retail environments, salespeople need to learn verbal communication skills as well as non-verbal skills. In terms of the latter set of skills, learning how to interpret basic body language skills is vital. This is because people give physical clues or hints as to what they are feeling, through hand movements, signals and subconscious gestures.

A good negotiator will thrive in these environments because clients and customers are always looking for ways in which to get a better deal for the product or service they require. Good negotiating skills could contribute to the formation of a loyal customer base, where the confidence of clients is vested in the respective company and its ability to provide good, fair deals.

Whether a newcomer or an experienced and knowledgeable salesperson is concerned, sales training courses are a great investment into the future of a sales company. They will equip newcomers with the foundational knowledge and skills they need to succeed while also keep more experienced members of a team, up to date with recent developments and technological advancements in the industry.

Article by Kevin Jacks

We all have to negotiate in each and every phase of life whether be it in the field of learning or in some other business. But sometimes it is hard negotiation such as negotiating a new piece of work, or a salary increase or even with the price we have to pay for a house, for an advertising campaign or for any used car. So sometimes it is also soft negotiations such as getting your child to do their homework or deciding who is going to do what in any one’s team or handling any staff conflict. The principles are the same though but differ at some minute points. So our negotiation programs for the negotiation training some how help people define their own rules and also the beliefs about negotiation and how they either support or get in the same way of the achievable success. From there we are able to look at individual negotiation style of each person and then develop negotiation skills of people in being able to see better what is going on for other people, or reading the body language, and also handling tricky meetings.

Like any game there are rules and conventions as in every case. So our approach to good negotiation is not about winning and it is not about someone else losing also. It is through negotiation training, however about learning to play the game in a much better way, only because that is what negotiation is simply a game. We always like to think our work is an aspiration, with more and more people getting a real feel and the actual flavor of how the best negotiators work. It is with subtlety and flair and with the knowing what to give away, when to make the actual demands and how to compensate when there are any difficulties. It also deals with how to let go of their positions, or giving up one want and also even choosing another.

Through negotiations training it also seems that some people are born for the negotiators and they relish doing the deals as well. But maybe in your company you may need a lot more than a toe when ever your people have to enter the negotiating fray in some time of the day. It may be that some times you have people who do need to do hard negotiations such as union or other contracts, or some other bargaining with suppliers, and some times reaching a settlement. As a result our work has been delivered to the private sector, the public sector and also to the individuals who want to develop their skills and finally become better at what they do.

The understanding of the feelings people have when they are required to raise their game is when they experience the noticeable change or when they need to be more effective, and motivated and also enthusiastic. The behavioral change is hard at the best of times but so we encourage change that is compatible with individuality of each person.

Creating and adhering to an approved budget is a core responsibility for project professionals. Part of your job will frequently be to work with your vendors and providers to get the best cost for the services or hardware your project requires. Becoming a savvy negotiator takes practice, but remembering a few core guidelines will help to quickly boost your negotiation skills.

Know the market

Before you try to finagle the lowest bid in history for the service or equipment you need, it’s important to know what the going market rate is in your area. Why? Because paying significantly below market could be a sign that you’re not getting what you think you’re getting-either in inferior products, inexperienced service providers, or even lackluster warranty coverage-and will end up paying more in the long term to resolve issues, upgrade equipment, or purchase additional parts. Beware, too, the risk you run if you continually expect vendors to submit ultra-low bids: it’s likely the most qualified and experienced vendors will stop bidding on your jobs, and while the remaining vendors may be hungry enough to stick around, you may no longer have access to top-tier providers.

By developing a thorough understanding of the market, you’ll also gain insight into where you can negotiate with the best chance of success. Are raw material costs highly volatile? Is manufacturing the most expensive phase? Can installers in another region be more competitive? Knowing the process from beginning to end will give you significantly more leverage.Know your resources and limitations

Oftentimes, successful price negotiations are all about knowing exactly what you need, when you need it, and how you need it done. Do you need to pay for expedited shipping, or will a standard leadtime meet your target date? Are your needs too complex for the local vendors? If you aren’t able to negotiate a good price, are you stuck paying a premium, or is there someone in-house qualified to do the work? Be careful that you don’t exclude vendors solely because of price, only to discover you have no other options.

Negotiation takes time and effort-when working with providers to get the best price, it’s important to remember that you have timeframes to maintain and other issues to monitor. Once you’ve massaged the bids to your liking, it’s time to pull the trigger and move on. A fair price for the services or equipment you need is the goal, and excessive negotiations could put the rest of your project in jeopardy.

Know what can-and can’t-be negotiated

A number of project items simply aren’t negotiable. Fees for permits, items required by a regulatory agency, specialty disposal services, some insurance costs, and many other expenses are often set by a municipality or government entity, and aren’t open to negotiation. For these items, gathering real-world costs early in the budget cycle is crucial, as you won’t be able to shave anything off them later.

It’s critical that you examine each bid closely when working with these types of costs. If vendors feel they must offer the lowest price to win your business, there’s a chance the less scrupulous among them will omit these fixed costs from their bids. Carefully evaluate each bid to ensure it encompasses all the costs likely to be involved in the project. It’s also your responsibility to know which expenses can be funneled through your vendors, and which must be paid directly by you or, if you’re working for a client, the project’s owner. Again, this applies most often to fees incurred through a municipality or agency with regulatory oversight.

Article by James Delrojo

One of the key elements in any negotiation is power, real or perceived. The more power you have the easier it is to achieve your objective. In this article I will discuss six elements that contribute to negotiation power.

You will notice that throughout this article the word “perceived” is often used. That is because negotiation is a mental and emotional activity. What the other party perceives to be the facts is more important than what the facts actually are.

You could have real power but if the other party does not realise this then your power will not be influential on their thinking and behaviour.

You could have no real power but be skilful at creating the perception that you have power and that perception can give you strong negotiation leverage.

Of course the best position is to have both real and perceived power.

Power Element 1: Low need

The strongest form of this element is knowing that you don’t have to do the deal. If the other party has a stronger need to make the deal than you do, then you are in the position to move them toward their maximum point of flexibility.

The best way to convey this low need is to demonstrate that you are willing to walk away from the negotiation.

Power Element 2: Credibility

There are three main elements that create credibility in a negotiation. They are perceived knowledge, having the facts on your side, and being a perceived authority.

When your credibility is high the other person is less likely to question what you say and more likely to doubt himself or herself if you are disagreeing with them.

Power Element 3: Inspiration

The element is made up of three primary attributes; charisma, confidence, and your ability to use verbal and interpersonal skills.

If you have and use these three attributes then what you say will carry a strong emotional impact and is far more likely to influence the other person.

Power Element 4: Time

Time can produce power in a number of ways.

If you have more time than your opponent then the closer you move to their deadline the greater your negotiating power becomes.

If you have patience and the other party is impatient then this can also produce power for you, whether there is a real time constraint or not. By stretching out the negotiation you can produce emotional tension in the other person so that this tension becomes a distraction and weakens their tactical skills.

Another aspect of time is art of timing. By knowing when in a negotiation to apply a particular tactic you can maximise the power of that tactic.

Power Element 5: Asset

There are numerous assets that could increase negotiation power. One of the best assets is to have something that the other party really needs. This can be even stronger if you have a virtual monopoly.

The term “virtual monopoly” simply means that the other party does not know anyone else who can fulfil their need.

Just because you are aware of your competition it does not mean that the person you are negotiating with is aware that you have competition. Always be on the lookout for signs of a virtual monopoly and be careful never to mention that your competition exists unless the other person has raised the issue.

Power Element 6: Negotiation Skills

Of course a lot of power comes from having better negotiation skills and experience that the other party has.

If you are better at using negotiation techniques and at camouflaging your true position then you can create the perception that you have a lot more power than you really do. As I said in the beginning of this article it is the perception of power that gives you leverage.

Article by Devora Witts

When negotiating one has to make use of all the abilities at hand in order to obtain the most without disrupting the negotiations. One does not have to be an expert negotiator to obtain a good deal. Following are some tips that can help you understand more the art of negotiation and will aid you in the process of reaching a deal with a third party whether the issue is financial related or not.

Win-Win Situations

The first thing you need to know about negotiations is that you should always aim to obtain a win-win situation where both parties feel as they have obtained something from the negotiations. If you expect a negotiation to result in a winner and a loser, then the negotiations will end up being too hard. Therefore, the first tip is: Aim to a win-win situation where both you and the third party obtain something.

Flexible Expectations

With the first tip as a lei motive, you should try to focus on what you expect to obtain from negotiations but with a great deal of flexibility on mind too. For instance, if you want to obtain A, B, and C being A the main thing you want, you need to consider a scenario where you get A and B and the other party keeps C or you get A and C and the other party keeps B. Or maybe you need to add D to the negotiations knowing that they will be interested in it when it does not mean that much to you. The second tip would be then: Define your main interest and be flexible with your alternative ones.

Know Yourself And Know The Other Party

Analyze your virtues and your weaknesses as well ass your interlocutor’s. This will help you to protect yourself from the other party’s negotiation techniques as well as exploiting their weaknesses on your benefit. In any case, you need to understand the need of subtleness. If you are taking advantage of a weakness it is important that the affected party does not realize that because otherwise that would negatively dispose them against you.

Patience, Patience, Patience

Yes, you may be eager to close on a deal but that will not necessarily happen right away and probably it is best that it does not. When you first sit down with the other party a negotiation process has started. Such processes have different parts and though all of them can be resolved within a day, it is advisable to held at least two reunions in order to obtain better terms for both parties. How? Easy, the first reunion should be focused on building a bond, giving good impressions showing yourself as cooperative people and stating your requirements and needs clearly.

As long as the other party does the same, the negotiations are on the right road. The time between reunions should be used to come up with solutions that provide both parties with at least part of the things they want. The second reunion should be used to exchange proposals and discuss them. If no solution is obtained, a third or even forth meeting can be held, each time with more information about the needs and desires of each party and new proposals.

Doors Ought To Remain Open

Even if you do not find a solution, it is a good idea to end conversations with a good impression. Do not get mad or transmit disappointment. Just express that in the event of new circumstances you may meet again to further discuss the situation. You never know what may happen to you or to the other party or up to what extend external circumstances may change providing your with a solution to whatever problem that got negotiations stuck.

Article by Ken Sundheim

Although I have a very keen eye for spotting a fair amount of negotiation tactics, I find negotiation, in most circumstances, to simply be a hindrance to the normal flow of business. For a moment, tally up the opportunity cost that you have seen wasted by others who want to negotiate arbitrary, meaningless things like the cost of pens at Staples. You would probably have a good chunk of change if you summed up all that wasted time and energy.Among many professionals, salary negotiation is a topic of inflated importance and is often written about in a very reckless, inaccurate manner by people who are off base to an extent that piques a tremendous amount of curiosity for me, both personally and as a sales recruiter. It took me years to come up with these salary negotiation “rules” I recommend most job seekers follow. They are broad, but since I started KAS, I find them to be the most reliable, in the widest variety of job offer situations.- Unless you need the money, don’t negotiate for a few thousand dollars. With a grin, I once saw a VP go back and forth with a 20 year old over ,000. How this VP is still gainfully employed, I don’t know. When two people who don’t know how to negotiate get together, they get a perception that each does. Both sides of the table appear to pretend that the boardroom table is a stand at some country bazaar. Therefore, before you go on the job search, make rules for yourself. Don’t get caught up in situations like the aforementioned. At best, you will waste time or leave a bad taste in the hiring manager’s mouth. At worst, you will lose what should have been a sure thing or a job you really wanted.Tell yourself what you’re going to graciously walk away from, what you’re going to sit on and what you’re going to sign the next day. Keep in mind that this number should shift in conjunction with how much you like the job, and its perceived strengths in terms of furthering your career progression. If you love the job, remember that you only live once and weigh what luxuries you must give up and do your best to make a decision.- You don’t know the employment market well enough to negotiateThere are too many complicated variables that go into compensation. When trying to gauge their worth on the market, job seekers tend to reference friends and old colleagues. What they don’t understand is that their friend could have been at the right place at the right time. For example, maybe the owner of the firm that hired your friend needed to hire someone and was very desperate to get a body in the organization. In this circumstance, about 20%+ compensation leverage went to the friend. This is just one of 20 different variables that throw people off when asking for any given compensation package. In any salary discussion, whether for a new job or a raise, citing an acquaintance’s or colleague’s compensation package is a weak argument. It’s the equivalent of saying, “Bobby got chocolate milk, so I shouldn’t have plain.”When it comes to numbers, the employer doesn’t know Bobby; all they know is their budget and their company goals.- Don’t fall into the benefits trapI always say to my corporate friends that if they get hit by a tank, they are sure as heck lucky not to have to pay the ambulance bill. If you’re younger, odds are you don’t require extensive health insurance coverage, beyond annual check-ups and some prescription coverage. For the majority of job seekers – especially those who don’t yet have families to insure – keep benefits out of the salary negotiation equation, all other things being equal. If you want to cut negotiations off and get a higher salary…Be candid about the fact that you don’t negotiate salaries. Now, the employer can trap you and ask for a specific number, but be vague and give a range. Let them come with the offer. If they come in way too low, walk away: undervaluing you is unprofessional on the employer’s part.Remember the emotions that go into negotiationBefore you go into heated salary negotiations for weeks on end over ,000, remember that you’re going to have to work with these individuals. The last thing you want to do is go into a new office with strange faces and feel uncomfortable.People make snap judgments on others, mostly in the time frame of four to seven seconds. Strangers know when you are upset or disgruntled more than your own family does, often because they haven’t become inured to your behavioral tics. This is not to mention that 80% of all communication is nonverbal. First impressions don’t last a lifetime, but they do last and are hard to change. The last first impression you want at your new job is a reputation as the new person who strained the budget unnecessarily.

When it comes to professional development and business training, it’s serious business – but that doesn’t mean the sessions themselves have to be all serious. Keeping your audience actively engaged with the workshop and mentally switched on to take in the valuable information being presented is a critical part of the training process. So how can you keep things interesting?Ice Breakers and ActivitiesIce breakers and warm ups are an essential part of any training session as they help to foster a sense of team and community – and they don’t just have to happen at the beginning of the session. Ensure you’ve factored in plenty of time for breaks and include some random activities and energisers to break up your session and keep attendees engaged. Here are some ideas:*Random facts: have attendees reveal something unusual about themselves – an interesting hobby or hidden talent. This gets people thinking outside of work and gives teams that are already familiar with one another the opportunity to learn something new. You can dress it up a little with some creative ideas, such as “2 truths, 1 lie” or other variations. *Active activities - it’s challenging for most individuals to sit and listen attentively for an extended period of time. Vary it up with some physical activities that require participants to stand up. Try this: have the group stand with a thumb up on the left hand and the index finger pointing forward on the right. Now tell them to switch (thumb up on the right and index finger forward on the left). And switch again. Many will find this simple task much more challenging than it sounds – but emphasise as in many situations, practice makes perfect. *The Pig Test: an interesting little personality test from Archer Training in the UK. Have participants draw a pig on a blank sheet of paper. Then reveal what their pig means. Remember to check the length of their tails! Many training leaders will reinforce the need that ice breakers and energisers reinforce the purpose of the training session, be it sales training or negotiation training. Be creative with your sessions and adapt them to the group’s personality. Meanwhile, it’s also important to keep instructions and set up minimal in the interest of time and comprehension.

Question by Murphy: Are lobbyists a necessary evil, or can they be elminated altogether?
I found this description from a California big business particularly interesting:

“If it is determined that the bill will hurt the industry, the lobbyist goes to work to either defeat the bill or to have it amended. This requires lobbying the author and members of the Legislature, working with the author’s staff and committee consultant, negotiation with other interested groups, and working with the association to coordinate effective grassroots lobbying, if necessary.

The lobbyist must also monitor the budget process and lobby to protect the industry from additional fees and taxes. Lastly, if the industry needs a change in the law, the lobbyist attempts to obtain an author for a bill and lobbies it through the legislative process.

The lobbyist must know the process, know who to contact, and ******have credibility in the legislative community****** (What exactly does THAT mean???). Like any other endeavor, it is essential to have someone who has the expertise to get the job done.” (source: http://www.cspnet.org/governmentaffairs/lobbyist.cfm)

Best answer:

Answer by CommonSense Christian
Lobbying is a part of the constitution

We need to get the money out tho
